TERMS & CONDITIONS OF SERVICE
SendNOW®
1. General Provisions
1.1
These Terms and Conditions of Service (the “Terms”) govern access to and use of the SendNOW website at https://sendnow.money, associated mobile applications and related digital interfaces (together, the “Platform”).
1.2
SendNOW is a technology platform that facilitates the initiation, monitoring and management of international money transfers. Regulated payment and money transfer services are provided by appropriately authorised banks, payment institutions, money transmitters or other financial services providers (“Payment Partners”), as applicable.
1.3
The Payment Partner responsible for a particular transfer may vary according to the sending and receiving countries, currencies and payment method. Where required by law, its identity and applicable supplemental terms will be disclosed before the user enters into the relevant payment service agreement.
1.4
By registering for or using the Platform, or by confirming a transfer, you acknowledge these Terms and agree to comply with them. Mandatory rights under applicable law always prevail over conflicting provisions of these Terms.
2. Definitions
2.1
“User” means an individual who registers for or uses the Platform. “Sender” means the User initiating a transfer. “Recipient” means the person or entity designated to receive funds.
2.2
“Transfer” means an instruction to send funds to a Recipient through a payment method available on the Platform. “Payment Order” means the Sender’s instruction for a specific Transfer.
2.3
“Payment Partner” means a bank, licensed payment institution, money transmitter or other regulated provider involved in processing a Transfer.
2.4
“Fee” means a charge disclosed to the User before confirmation of a Transfer. “Exchange Rate” means the conversion rate quoted for the relevant currency pair.
2.5
“Business Day” means a day on which the relevant financial institution is open for the operations necessary to process the Transfer, taking account of local holidays.
3. Eligibility
3.1
You must be at least 18 years old or have otherwise attained the age of legal capacity required under applicable law.
3.2
You must have the legal right to use the funds involved in a Transfer and must provide true, current and complete information.
3.3
Availability depends on your location, residence, nationality, identity verification status and legal or operational restrictions. Registration does not guarantee access to any route, currency or payment method.
3.4
Use of the Platform on behalf of another person or a business is permitted only if expressly supported by the relevant service and after all necessary checks.
4. Account Registration and Security
4.1
An account may be required to initiate a Transfer. Available sign-in methods may include email, Apple, Google or other supported authentication methods.
4.2
You must protect your credentials and promptly report suspected unauthorised access. You may not transfer your account, submit another person’s identification documents or create accounts to circumvent limits.
4.3
Payment instruments ordinarily must be held by the registered User. Third-party payment instruments may be used only where expressly permitted by SendNOW and the relevant Payment Partner.
4.4
Additional authentication may be required for logins, changes to recipient details or sensitive transactions.
5. Identity Verification, AML and Sanctions
5.1
SendNOW and its Payment Partners may carry out identity verification, anti-money laundering, counter-terrorist financing, sanctions screening, fraud prevention and other compliance checks.
5.2
Checks may require your name, date of birth, nationality, residential address, identity document, proof of address, source of funds, purpose of transfer, relationship with the Recipient and other reasonably necessary documents.
5.3
Checks may take place before, during or after a Transfer, and periodically throughout the customer relationship.
5.4
A Transfer or account may be delayed, restricted or refused on reasonable compliance, fraud-prevention or legal grounds. Some countries, institutions or Recipients may be unavailable or subject to enhanced checks.
5.5
You must not use the Platform to evade sanctions, exchange controls, reporting obligations or other applicable legal restrictions.
5.6
We may be legally restricted from disclosing specific reasons for a review or suspension. Funds will not be automatically forfeited because a Transfer is restricted; their treatment will be determined by law and instructions of competent authorities.
6. Initiating and Executing Transfers
6.1
When creating a Transfer, you provide the destination, amount, currency, payment method and required Recipient details.
6.2
Before confirmation, the Platform will disclose the sending amount and currency, the amount and currency expected to be received, the quoted Exchange Rate, applicable Platform Fees, known additional charges, the estimated delivery time and the payout method.
6.3
By confirming a Transfer, you authorise transmission of the information required to process it and consent to execution on the disclosed terms.
6.4
The time of receipt, acceptance and irrevocability of a Payment Order is determined by the relevant Payment Partner’s terms and applicable law.
6.5
You must verify Recipient details carefully. Incorrect information may result in delay, rejection or payment to the wrong person. Notify us immediately if you discover an error.
6.6
We will use reasonable efforts to assist with correcting or recovering an erroneous payment where legally and technically possible. Cancellation or amendment cannot be guaranteed once processing has begun.
6.7
A Transfer is completed once funds have been credited to the Recipient or the payment obligation has otherwise been discharged in accordance with the applicable payment-system rules.
7. Payment Methods
7.1
Depending on the payment corridor, available methods may include Visa or Mastercard cards, Apple Pay, Google Pay, bank transfers or other methods presented in the Platform.
7.2
Availability may change for technical, operational, compliance or legal reasons.
7.3
You warrant that you are authorised to use your selected payment instrument. Your issuing bank or another external provider may apply fees, including cross-border, foreign exchange or cash-advance charges. We will disclose such fees where we know of them and disclosure is required.
7.4
If your payment is declined, the Transfer may be cancelled or remain pending payment. Suspected payment fraud, abusive chargebacks or unauthorised use may trigger investigation and proportionate restrictions as permitted by law.
8. Exchange Rates and Fees
8.1
Fees and Exchange Rates depend on the amount, currencies, destination, payment method and other disclosed factors.
8.2
The quote presented before confirmation sets out the applicable terms of the particular Transfer.
8.3
An Exchange Rate may include a commercial margin and may differ from central-bank, interbank or market-reference rates.
8.4
If a rate is guaranteed for a specified period, that guarantee applies only within the stated validity period and subject to conditions such as timely receipt of payment.
8.5
If the payment is late or material circumstances change, a new quote may be required. Terms already agreed will not be changed except as permitted by the contract and applicable law.
8.6
SendNOW does not intentionally impose undisclosed Platform Fees. Known charges collected through the Platform will be shown before confirmation. Separate promotions and referral incentives may have additional terms.
9. Transfer Limits
9.1
Minimum and maximum Transfer amounts may vary by country, currency, payment method, verification level and Payment Partner requirements.
9.2
The applicable limit will be displayed or communicated before confirmation. Per-transaction and aggregate limits may apply.
9.3
Limits may be adjusted for legitimate legal, compliance, security or operational reasons. Structuring multiple Transfers to evade applicable limits or required checks is prohibited.
10. Processing Times
10.1
Processing depends on the payment method, banking networks, submission time, destination and required reviews.
10.2
Any stated delivery timeframe is an estimate unless a binding execution time is expressly agreed for the Transfer or required by law.
10.3
Delays may result from AML/KYC or sanctions review, technical incidents, incorrect details, bank or payment-system processing, weekends, holidays or events beyond reasonable control.
10.4
If a Transfer is delayed, you may contact support for a status update. Applicable statutory timeframes and duties remain binding on the responsible service provider.
11. Cancellation
11.1
You may request cancellation through the Platform where available or by contacting support.
11.2
Whether a Transfer can be cancelled depends on its processing stage and the point at which the Payment Order becomes irrevocable.
11.3
If cancellation is legally available before execution, the relevant amount will be returned under the applicable rules. Once funds are delivered, recovery may require the Recipient’s or relevant institution’s cooperation.
11.4
Nothing in these Terms restricts a statutory right to revoke a payment instruction or receive a refund. Any permissible cancellation or recovery fees will be disclosed in accordance with law.
12. Failed Transfers and Refunds
12.1
If a Transfer cannot be completed, SendNOW and the relevant Payment Partner will investigate the reason for failure.
12.2
Where funds cannot be delivered, the amount due for refund will be returned to the original payment instrument or by another lawful method.
12.3
Where failure was not caused by a breach of your obligations, the full amount you paid for the Transfer, including the SendNOW Fee, will be refunded in accordance with the applicable refund policy and mandatory law.
12.4
Where a Transfer was properly completed, recovery may be subject to applicable payment-system rules and Recipient rights; successful recovery cannot be guaranteed.
12.5
If the failure arose from inaccurate information provided by you, any permissible deductions must comply with applicable law and any agreed fee disclosures.
12.6
Refund settlement times depend on the involved bank or payment provider. Legal holds or official orders may prevent disbursement until the restriction is lifted. You may request progress information and submit a complaint.
13. Unauthorised or Incorrect Transfers
13.1
Notify SendNOW without undue delay if you identify a Transfer you did not authorise or an error in its execution.
13.2
Where possible, provide the transaction reference, an explanation and relevant supporting information.
13.3
We will help refer the matter to the responsible Payment Partner. Liability, evidence requirements, notification periods and reimbursement rights are governed by applicable law and the relevant payment services agreement.
13.4
Nothing here excludes mandatory reimbursement or other legal protections for unauthorised or incorrectly executed transactions.
14. Prohibited Activities
14.1
You must not use the Platform for money laundering, terrorism financing, fraud, dealing in stolen funds, sanctions evasion, unauthorised use of payment instruments, falsified documents, concealed beneficial interests, illegal transactions or interference with Platform security.
14.2
We may reject Transfers, restrict accounts and make legally required reports where justified. We are not obliged to execute an instruction where doing so would breach applicable law.
15. Suspension and Termination
15.1
We may temporarily restrict access where reasonably necessary because of account compromise, suspected fraud, violation of these Terms or legal obligations.
15.2
Restrictions will be proportionate to the circumstances. We will communicate them and provide support channels unless notice is prohibited by law or would compromise an investigation.
15.3
You may request account closure through an available self-service mechanism or support.
15.4
Closure does not extinguish pre-existing obligations or pending Transfers. Personal information will be retained or erased according to the Privacy Policy and legal retention duties.
16. Scams and Transfer Safety
16.1
You are responsible for assessing the identity and trustworthiness of the intended Recipient. Unless expressly stated otherwise, SendNOW is not a party to an underlying sale or service agreement between Sender and Recipient.
16.2
We do not warrant goods, services or promises made by a Recipient. Be cautious of pressure tactics, unknown Recipients and promises of guaranteed investment returns.
16.3
Report suspected scams immediately. We will provide reasonable assistance with investigation and any legally or technically available recall procedures.
16.4
This section does not limit mandatory rights relating to unauthorised or incorrectly executed payments.
17. Privacy and Personal Data
17.1
Personal data is processed according to the SendNOW Privacy Policy and applicable data-protection legislation.
17.2
Information may include identifiers, contact details, payment information, transaction records, device data and verification results.
17.3
Where legally permitted and necessary, data may be shared with Payment Partners, identity verification services, banks, fraud-prevention providers and competent public authorities.
17.4
International transfers of personal data will be subject to safeguards required by applicable law. The Privacy Policy explains purposes, legal bases, retention periods, individuals’ rights and privacy contacts.
18. Intellectual Property
18.1
The Platform’s software, designs, interfaces, trademarks, content and other protected elements belong to SendNOW or the relevant rightsholders.
18.2
You receive a limited, non-exclusive, non-transferable right to use the Platform for lawful personal access to supported services.
18.3
Unauthorised copying, modification, reverse engineering, redistribution or commercial exploitation is prohibited except to the extent permitted by mandatory law.
19. Platform Availability
19.1
We take reasonable measures to maintain reliable and secure Platform operations.
19.2
Features may be interrupted for maintenance, updates, security incidents or third-party infrastructure failures. Uninterrupted access cannot be guaranteed.
19.3
Technical limitations do not eliminate obligations or consumer protections that cannot lawfully be excluded.
20. Liability
20.1
Each Payment Partner is responsible for regulated payment services it provides in accordance with its agreement and applicable law.
20.2
Except as expressly agreed, SendNOW is not liable for a Recipient’s separate failure to deliver goods or services to a Sender.
20.3
Any exclusion of indirect or consequential loss or loss of profit applies only to the extent lawful and enforceable.
20.4
Nothing excludes liability for fraud, wilful misconduct or any matter for which liability cannot lawfully be excluded, or limits mandatory consumer reimbursement and compensation rights.
21. Complaints and Dispute Resolution
21.1
You may submit a complaint through the Platform’s customer support channels.
21.2
Please include your contact details, Transfer reference (if available), description of the issue and preferred resolution.
21.3
We will acknowledge or register the complaint and refer regulated payment-service complaints to the responsible Payment Partner as appropriate.
21.4
Complaints will be handled within timelines prescribed by applicable law. We will provide information about the outcome and, where required, further avenues for escalation.
21.5
If dissatisfied, you may use available alternative dispute resolution mechanisms, complain to the competent financial regulator or bring proceedings before a competent court.
21.6
Information on the relevant regulator and external complaint body will be provided as applicable to the particular provider and jurisdiction.
22. Force Majeure
22.1
A party is excused from performance only to the extent a qualifying extraordinary event beyond its reasonable control prevents performance and applicable law permits such relief.
22.2
Events may include natural disasters, armed conflict, major infrastructure failures or binding government measures.
22.3
Such an event does not automatically extinguish repayment obligations or non-waivable consumer rights. Affected parties must take reasonable steps to mitigate its impact.
23. Changes to These Terms
23.1
We may update these Terms to reflect law, security requirements, services or operating procedures.
23.2
Material changes affecting Users’ rights or obligations will be notified in advance within the period and manner required by applicable law.
23.3
Where affirmative consent is required, the change takes effect for the User only after that consent is obtained.
23.4
Changes will not retrospectively alter previously agreed Transfers except where permitted by mandatory law.
23.5
The current version will be published at https://sendnow.money together with its effective date.
24. Governing Law and Jurisdiction
24.1
These Terms are governed by the laws of Canada, subject to mandatory consumer protections and the laws governing the relevant regulated payment service.
24.2
A choice of law does not deprive consumers of non-waivable protections afforded by the laws of their habitual residence where applicable.
24.3
Disputes shall be brought before courts having jurisdiction under applicable procedural and consumer-protection rules. Nothing restricts a mandatory right to sue in a competent court.
25. Miscellaneous
25.1
If any provision is invalid or unenforceable, the remainder remains effective to the extent legally possible.
25.2
Failure to enforce a provision is not a waiver of the associated right.
25.3
Users may not assign rights or obligations without consent except where permitted by law. A permitted corporate reorganisation or business transfer will not diminish mandatory customer rights.
25.4
These Terms are issued in English. Where translations are provided, any priority clause must operate consistently with mandatory consumer-information requirements.
